You’ve heard all about CBD oil. You know it can do wonders for several ailments including anxiety. But is CBD oil legal?

In 2018 Congress passed the Farm Bill legalizing hemp as long as the THC levels are lower than 0.3%. Now that CBD oil is legal in all 50 states, the sales of it are absolutely skyrocketing. However, the true legality of hemp remains shadily unclear and a very gray area within the law.

Overall, the federal government seems to be leaving the matter to each state. Some states have varying degrees of legality for marijuana which complicates what you can or can’t buy depending on where you live.

Check your state’s laws, but let’s look at the overall picture of what is legal in all 50 states.

The unfortunate answer is that you really can’t. Fortunately, however, from what has been seen by law enforcement is that they are not cracking down on buyers of CBD oil. 

Some states explicitly prohibit stores from making any health claims about CBD oil and the stores that were making such claims have been raided by the FDA. However, the DEA has made it pretty clear that they are not in the market for tracking down CBD oil suppliers or buyers.

If you live in a state that has not yet legalized marijuana, and you work in a job that will likely test you for drug use, then you will want to take extra precautions when choosing who you buy CBD oil from and what products you buy. However, most states are not looking to bust CBD oil buyers regardless of what they are purchasing.

To be THC or not to be

So, how can you know what you are buying? The best way to protect yourself is to buy from a reputable source. Do your research and know what you are looking for. Most notably, what you want to see on any website selling CBD oil is that they:

  • Use a third party lab for testing
  • Use pure CBD oil extract
  • Publish or offer to provide their latest lab reports
  • Use full spectrum CBD
  • Where the plants were grown

In short, CBD oil is legal in all 50 states as long as it contains less than 0.3% levels of THC. Additionally, 20 states have legalized medical marijuana making it legal for you to consume any form of CBD oil regardless of its THC levels as long as you have a recommendation from your doctor. 

As more and more states legalize both medicinal and recreational use of marijuana, the exact levels of THC will not be as vital to monitor.

But for now, to play it safe. Be sure that whatever company you purchase from shows their third party lab testing results.

So, this way, you can rest assured knowing you are on the right side of the law while also enjoying the many positive side effects CBD oil can have.
